Penenberg argues that the FCC may be necessary to oversee the division of the broadcast spectrum, but it is out of its depth when it comes to regulating content, as demonstrated by embarrassing controversies over Bono's swear word, the Janet Jackson incident and the agency's moves against Howard Stern. "There is simply no reason for the FCC to regulate broadcast content," Penenberg says. "By doing so, it is acting as a censor board."
